Kianjokoma Brothers Murder Case: Suspects Want Bodies Exhumed

Six police officers accused of the extrajudicial killing of two brothers from Kianjokoma in Embu County want their bodies exhumed.

Through their lawyer Danstan Omari, the suspects filed an application at the Milimani Law Courts on Thursday, August 26, seeking suspension of the prosecution to allow for fresh investigations.

The six; Benson Mbuthia, Consolota Kariuki, Nicholas Cheruiyot, Martin Wanyama, Lilian Cherono and James Mwanikiwere, want the court to order that an inquest be conducted first before any charges are preferred against them.

“We want an inquest into the brothers’ deaths conducted before the suspects are formally charged. As a result, we are asking the court to issue an exhumation order and allow for fresh postmortem,” said Omari.

They argue that when the first postmortem was conducted, their chosen pathologists were not present.

The cops insisted that the deceased brothers, Benson Njiru, 22, and Emmanuel Mutura, 19, “in a suicidal act while escaping lawful custody jumped out of the moving police vehicle thus succumbing to injuries.”

A lawyer representing the brothers’ family, Muchangi Gichugu, said they would oppose the suspects’ applications.

“The boys’ autopsies were conducted in the presence of police, the Independent Medico-Legal Unit (IMLU), the Independent Policing Oversight Authority (IPOA), lawyers, both private and government pathologists and representatives of the family. The examination, having been conducted in the presence of all these people, was credible. We shall, therefore, oppose any exhumation applications filed by the defence,” said Gichugu.

Omari said the autopsy findings that the brothers died of blunt force trauma “could be as a result of the fatal fall after jumping off the vehicle”.

The six officers also want the court to order that their phones be released so as to transfer money to their families and lawyers.

“A conservatory order be issued restraining IPOA, DPP and IG from commencing any criminal proceedings relating to the death of the deceased until the inquest is concluded on merit,” reads the petition.

They also want to be released on bail pending the conclusion of an inquest in respect of the death of the two brothers.

The officers are still being held at Capitol Hill police station and their matter will be mentioned next Tuesday.

4.5m Doses of COVID-19 Vaccines Expected Next Month

The Ministry of Health in Kenya says it is expecting to receive some 4.5 million COVID-19 vaccines by mid September to boost vaccination efforts in the country.

Dr Willis Akhwale spoke at a media round table on Wednesday, revealing that by August 21, Kenya had received approximately 3.6 million doses of both the Oxford AstraZeneca vaccines and Moderna.

The chairperson of the task force on vaccine deployment  added that the country anticipates 1.7 million doses of Pfizer vaccine by mid-September, 2 million doses of Sinopharm vaccine in September, and 893,600 doses of Johnson and Johnson vaccine between now and next month.

He noted that China’s Sinopharm vaccine has not been licensed for administration to persons above 60 years.

The Ministry of Health insisted that the government will be the sole importer of vaccines.

“The only importer and distributor is the government, the gov’t will facilitate the vaccine procurement even for the private sector,” Dr Willis Akhwale said.

The Health ministry urged Kenyans to get the vaccines, saying the bulk of recent deaths had been among elderly individuals aged 60 and over, followed by those aged 50 to 59.

Dr Akwale also implored Kenyans to get the readily available jabs as waiting for their vaccine of choice may be an exercise in futility. 

“If you wait for your vaccine choice, you may wait until you die…I know that is what is happening,” Dr Akhwale added.

Dr. Joseph Sitienei, Head of the Department of Health Sector Monitoring also urged those who have not received their second doses to do so. 

So far, about 3 percent of Kenya’s population has been fully vaccinated against the COVID.19.

“Some people may get the 1st jab and disappear. We are going to track those who have not gone for 2nd dose…one jab is not enough,” Dr. Sitienei said.

CS Matiang’i Likens DP Ruto Hitler, Warns Kenyans of ‘Hustler’ Trap to Hell

Interior Cabinet Secretary Fred Matiang’i has launched a scathing attack on Deputy President William Ruto’s ‘hustler narrative’, likening it to Adolf Hitler’s Nazism.

Speaking at the 64th General Assembly of the National Council of Churches of Kenya (NCCK) in Limuru on Wednesday, August 25, the CS noted that the German dictator had promised Germans ‘heaven’ only to deliver ‘hell’.

Matiang’i cautioned Kenyans against falling into DP Ruto’s ‘Hustler’ trap in the upcoming elections, saying it is masked with dictatorial and tyrannical intentions.

“Hitler during the campaign in Germany, told Germans to give him five years and he will give them a different Germany, and he actually gave them a seriously different Germany because he slaughtered the Jews, gas chambers and so on,” Matiang’i said.

He added: “Hitler moved around sweeping the country, taking advantage of poverty and weaponizing the poverty of the people and then now using it as a platform. Let’s not fall trap to things that are not true and are not realistic.”

The CS urged Kenyans to take the upcoming elections seriously, saying it is the most consequential of all the elections that Kenya has had in the past.

“This election is going to be the most important election we ever had because it is going to be a serious transition and one that could change the course of this country,” he observed.

Gov’t Addresses Reports of Fake COVID-19 Vaccines in Kenya

The government has denied reports that there are fake COVID-19 vaccines in the country.

According to the reports, the fake vaccines were brought into Kenya through Uganda. This comes after the World Health Organisation (WHO) raised a red flag over the existence of fake Covid-19 vaccines circulating in Uganda.

The WHO asked neighbouring countries to be on high alert.

Speaking Thursday, Government Spokesman Cyrus Oguna assured Kenyans that the vaccines in hospitals countrywide are genuine.

“The government cannot allow fake vaccines to enter into the country,” he stated.

Oguna, however, raised the alarm over some Kenyans whom he said are conducting unscrupulous businesses using the vaccines.

“We are aware of people who have already been vaccinated twice but they are conducting business. They wake up in the morning, go to the vaccination centres to line up for the jab, only to later sell their space at Sh100; this is wrong. Those found selling their lines in the vaccination centres will be arrested and charged in court. The jab is free,” said Oguna.

The spokesman said the country is currently administering Moderna and AstraZeneca jabs.

“If there are other reports (about any other vaccines), those are fake. CNN also aired a story that people are scared of going for the jab.  That is untrue because as at now, many Kenyans have been vaccinated, especially the elderly. We are now urging the youth and those with opportunistic diseases to go for the jab. We don’t have fake vaccines in Kenya,” Oguna said at the Mama Ngina Waterfront in Mombasa.

Self-confessed Moi’s Bridge Child Killer Evans Juma Wanjala Faces Murder Charges

The self-confessed pedophile serial killer Evans Juma Wanjala was on Wednesday, August 25 arraigned at the Kapenguria High Court.

Wanjala faced three counts of murder over the deaths of Linda Cherono, 13, Mary Elusa, 14, and Stacy Achieng, 10.

On the first count, the court heard that Wanjala murdered Stacy Achieng Nabiso on the night of December 31, 2019, in Soweto estate in Moi’s Bridge, Soy Sub County.

On count two, the suspect was accused of murdering Mary Elusa between December 15 and 16, 2020, in Tuiyabei village.

Evans Wanjala was also charged with committing murder on Linda Cherono within Moi’s bridge area between June 11 and June 15, 2021.

The suspect denied all the charges before Judge Justus Bwonwonga.

Wanjala’s lawyer, Michael Wabomba Masinde, filed an affidavit for the suspect to be bailed out but assistant Director of Public Prosecutions Jalson Makori  opposed his release on bail.

“I was served the three affidavits to court not to grant the suspect any bond. He is a dangerous man because he has other murder cases,” said Mr Makori, adding that if the accused is released on bond he might interfere with witnesses.

Justice Justus Bwongonga ordered the suspect to be remanded at the Eldoret GK prison.

“The bail will be determined by the Eldoret High Court. If given the bail, he might interfere with the murder case,” said the judge.

Justice Bwongonga further directed the case to be mentioned on September 8 before the Eldoret High Court.

DNA Test Results For Moi Grandson Released

The grandson of the late former President Daniel Arap Moi is the biological father to two children in a case where he is being sued for child support.

Results of a paternity test which Collins Toroitich Kibet Moi had demanded proved that he sired the two children with Gladys Jeruto Tagi.

The DNA test results returned a 99.9 percent probability. “The children exhibit a compatible obligatory paternal allelic profile with that of Collins Toroitich Moi,” read the report.

The results come after Collins played cat and mouse with the courts and his baby mama, dodging court appearances and the extraction of samples for the DNA analysis.

This forced Gladys Jeruto to sue Collins for contempt of court.

Baringo Senior Resident Magistrate, Benjamin Limo, released Collins Kibet on a Sh100,000 bond on charges of skipping court appearances.

In the suit, Gladys Jeruto Tagi is seeking Sh1 million per month for the basic needs of their children aged 11 and nine.
